Terms of Use
These Terms of Use (“Terms”) are an agreement between you and the independent developer of Sakaba (“we”, “us”, “our”). They cover the Sakaba app and this website. Please also read our Privacy Policy, which explains what data Sakaba handles.
1. Accepting These Terms
By downloading, installing or using Sakaba, or by using this website, you agree to these Terms. If you don’t agree, please don’t use Sakaba.
If you got Sakaba from the App Store, Apple’s Licensed Application End User License Agreement also applies. If the two conflict, these Terms apply as far as Apple’s rules allow.
2. What Sakaba Is
Sakaba is a home-bar app for iPhone and iPad: a curated library of cocktail recipes, guided mixing, a tasting journal and tools for your home bar. We may add, change or remove recipes and features over time, including the recipes in the free tier.
3. Age and Responsible Drinking
Most of Sakaba’s recipes contain alcohol. Sakaba is for adults of legal drinking age where they live. By using it, you confirm that you are. If you are under that age, use Sakaba only for its non-alcoholic recipes.
Drink responsibly, know your limits, and never drink and drive or drink while pregnant. You are responsible for following the alcohol laws where you are.
4. Recipes, Safety and Accuracy
Sakaba’s recipes, strength estimates, flavor profiles and articles are for general information and enjoyment. They aren’t medical, nutritional or safety advice. In particular:
- Strength is an estimate. The alcohol content Sakaba shows is calculated from typical bottles and pours. The real strength of your drink depends on what you use and how you make it.
- Raw eggs. Some recipes use raw egg or egg white, which carries a risk of foodborne illness, especially for pregnant people, children, older adults and anyone with a weakened immune system.
- Fire. A few recipes call for flaming a drink or garnish. Do this only with care, away from anything flammable, and never pour spirits from the bottle near a flame.
- Allergies. Check every ingredient against your own allergies and intolerances.
- Non-alcoholic recipes may include ingredients, such as bitters or kombucha, that contain small amounts of alcohol.
We work to keep recipes accurate, but we don’t guarantee that any recipe is free of errors or will suit you.
5. Your Content
Sakaba has no account. The recipes, notes and photos you create are stored on your device and, if you turn on iCloud, in your own iCloud account (see the Privacy Policy). You own your content. We claim no rights to it and never receive a copy.
You are responsible for keeping your content safe. iCloud sync depends on Apple’s services and your settings, so keep your own copy of anything you value; with Sakaba Plus, Export & backup saves everything to a file.
6. Sakaba Plus
Sakaba is free to download. The free tier includes a selection of recipes and limited use of some features. Sakaba Plus unlocks the full recipe library and the extra features described in the app. It is offered as a monthly subscription, a yearly subscription and a one-time lifetime purchase. The current prices and what each includes are shown in the app and on the App Store before you buy.
- Billing. Apple charges your Apple Account when you confirm the purchase. Apple is the seller: it processes the payment, and we never see your payment details.
- Automatic renewal. Monthly and yearly subscriptions renew automatically at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for the renewal within the 24 hours before the period ends.
- Cancelling. You can manage or cancel a subscription at any time in Settings → [your name] → Subscriptions. Cancelling stops the next renewal; you keep Sakaba Plus until the end of the period you paid for.
- Free trials and offers. If an introductory offer or free trial is available, its terms are shown before you subscribe. Any unused part of a free trial ends when you buy a subscription or the lifetime purchase.
- Lifetime. The lifetime purchase is a one-time payment with no renewal. It unlocks Sakaba Plus for as long as Sakaba is offered on the App Store and supports your device, on the Apple Account that bought it. “Lifetime” refers to the life of the app, not of a person.
- Price changes. If a subscription price changes, Apple tells you in advance and, where required, asks for your consent.
- Restoring and sharing. Purchases are tied to your Apple Account. To restore them on another device, tap Restore on the Sakaba Plus screen in the app. Where Family Sharing is available, Sakaba Plus may be shared with your family group.
- Refunds. Refunds are handled by Apple under its own policies; request one at reportaproblem.apple.com. Any legal right to withdraw from a purchase is exercised with Apple, as the seller.
7. Your License
We give you a personal, non-exclusive, non-transferable license to use Sakaba on Apple-branded devices that you own or control, as allowed by the Usage Rules in Apple’s Media Services Terms and Conditions (including through Family Sharing). You may not rent, lend, sell or redistribute Sakaba.
8. Intellectual Property
Sakaba’s design, code, illustrations, photographs, recipe texts, descriptions and articles, and the Sakaba name and logo, belong to us and are protected by copyright and trademark law. Classic cocktail recipes are part of a shared bartending tradition and belong to no one; what is ours is our own writing, presentation, selection and arrangement of them.
You may use Sakaba and this website for personal, non-commercial purposes and share individual recipes with friends, including with the app’s share card. You may not copy, scrape or republish Sakaba’s recipe library or articles in bulk, or use them to build a competing product or to train machine-learning models.
9. Brand Names
Recipes and articles mention spirits and other products by their brand names (for example Campari or Cointreau) so you know what to pour. These names are trademarks of their owners. Sakaba is not affiliated with, sponsored or endorsed by any of them.
10. Acceptable Use
You agree not to use Sakaba to break any law; not to copy, decompile, reverse-engineer or modify the app except where the law allows it; not to get around its purchase checks; and not to interfere with the app, this website or the services they rely on.
11. Links and Other Services
Sakaba and this website link to and rely on services we don’t control, such as the App Store, iCloud and other websites. Their own terms apply, and we aren’t responsible for them. You must also follow the terms of any third-party service you use with Sakaba, such as your mobile data provider.
12. Disclaimer of Warranties
To the fullest extent the law allows, Sakaba and this website are provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose. We don’t guarantee that Sakaba will be uninterrupted, error-free, or available on every device or iOS version, or that content will always sync or be preserved.
13. Limitation of Liability
To the fullest extent the law allows:
- We are not liable for any indirect, incidental, special or consequential damages, or for loss of data, arising from your use of Sakaba or this website.
- We are not liable for any harm arising from preparing or drinking drinks made with Sakaba’s content. What you make and drink, and how much, is your responsibility.
- Our total liability for any claim relating to Sakaba is limited to the amount you paid for Sakaba in the 12 months before the claim.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.
14. Your Rights as a Consumer
If you live in a country whose consumer laws give you rights that cannot be waived by contract, those rights still apply. These Terms do not take them away.
15. Apple
Because Sakaba is distributed through the App Store, you and we both acknowledge that:
- These Terms are between you and us only, not Apple, and we, not Apple, are solely responsible for Sakaba and its content.
- Apple has no obligation to provide any maintenance or support for Sakaba.
- If Sakaba fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. To the maximum extent the law allows, Apple has no other warranty obligation regarding Sakaba, and any other claims, losses, liabilities, damages, costs or expenses due to a failure to conform to a warranty are our responsibility.
- We, not Apple, are responsible for addressing any claims by you or a third party relating to Sakaba or your possession and use of it, including product liability claims, claims that Sakaba fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If a third party claims that Sakaba or your possession and use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.
Questions, complaints or claims about Sakaba go to us at sakabaapp@proton.me.
16. Ending These Terms
You can stop using Sakaba at any time by deleting it. If you seriously break these Terms, your license to use Sakaba ends. We may change or stop offering Sakaba or any feature; if that affects a paid subscription, Apple’s refund policies apply where the law requires.
17. Changes to These Terms
We may update these Terms from time to time. We will change the “Last updated” date above and, for a significant change, say so in the app before it takes effect. If you keep using Sakaba after a change, the updated Terms apply. If you don’t agree, stop using Sakaba and cancel any subscription.
18. General
These Terms are governed by the laws of the place where the developer of Sakaba is established, without regard to conflict-of-law rules, and without taking away the protection that the mandatory laws of your country of residence give you as a consumer. If any part of these Terms can’t be enforced, the rest still applies. If we don’t enforce a right, we haven’t given it up. These Terms, the Privacy Policy and, where it applies, Apple’s license agreement are the whole agreement between you and us about Sakaba.
